Fees and Conditions

Read carefully. These terms will apply to all services provided by Transient Captures Media ("Transient Captures", "i", "us" or "we") to you, the customer, ("you"). We will not accept any variation to these terms and conditions unless specifically agreed upon in writing by Transient Captures Photography. By making a booking you have agreed to these terms and conditions in full. 

To reserve a session date, Client shall pay to the Photographer, a non-refundable 50% retainer. Dates are not held without paid retainer. This retainer is required to confirm booking and is due within 48 hours of booking (NOT 48 hours of session date). Client understands and agrees that Photographer will not book other sessions during this time. In the event that Client cancels the photography session or fails to attend the session on the Session Date, for any reason, Photographer shall suffer losses that are difficult to ascertain. Client must cancel a session within 5 days of booking confirmation to receive a partial refund. As such, Client agrees to forfeit the full 50% deposit; paid to Photographer as liquidated damages and not as a penalty. Client and Photographer agree that such amount is reasonable. If you are more than 20 minutes late, the session will be cancelled and is non-refundable and non-transferable. Once booked, sessions are subject to a $25 rescheduling fee if you reschedule your reserved spot within 72 hours of your scheduled session time. A $40 rescheduling fee is assessed if session is rescheduled after 10 minutes up to 30 minutes of session start. Fees not applicable if session is cancelled/rescheduled due to unreasonable weather or photographer canceling. This being said, Photographer can not be held responsible for weather. If weather is not acceptable to client , but not a cause to reschedule, all standard rescheduling fees apply otherwise deposit is forfeited as a cancellation. Sessions can be rescheduled by phone, text message or email prior to session date.

If the weather does not permit for the completion of a session, i.e. has to be rescheduled due to the weather, the photographer will make all reasonable effort to accommodate the clients schedule. The client will be given dates and times that are available on the photographers calendar. If the client is unable to make any of the available times, the client can reschedule within 6 months of the original date with no additional rescheduling fees. After 6 months the original initial fee is void. Again, The photographer is not responsible for the weather, and if the client refuses to reschedule the session, the initial fee is then forfeited. 

We reserve the right to terminate a session immediately in the event that you are uncooperative, disruptive or abusive to us or any of our employees or contractors. In the event that we terminate the agreement under this clause your initial fee will be forfeit. If subjects are unwilling or uncooperative photographer will not be held responsible.

Your online gallery link will be e-mailed to you within 7-14 business days of your session (excluding weddings) and will be viewable for only 14 days. Edit selections must be made prior to expiration of proofing gallery. If no order is placed by expiration date a $15 extension fee will be applied to extend gallery for an additional 30 days. Edited final photos are uploaded and held on file in Client gallery for minimum of 3 months for further purchasing options.

Please be advised that all experiences and pricing are subject to change without notice. Any experience booked 48 hours prior to changes (secured by deposit) will be honored. All pricing is subject to 6% sales tax. Cash, Credit Card, or Personal Check accepted. Travel fee may apply to sessions 40+ miles outside of the Metropolitan Detroit Michigan Area.

All Photographs taken by Transient Captures Media are property of Transient Captures Media and are protected by the United States Copyright Laws (USC Title 17). We will retain all intellectual property rights (including copyright) in the photographs and other materials delivered to you. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. Client hereby waives any claim for ownership, income, editorial control and use of the images. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. All images are copyrighted by Transient Captures. We retain ALL copyrights to our photographs/files. When purchasing digitals you receive PRINTING rights. Upon payment of our fees in full you will be granted a license for personal and family use of images. This license does not include any commercial use of the photographs for which an additional fee will be payable. Thank You.
